Abstract

The rapid development of information technology has significantly transformed various aspects of human life, including the emergence of online gambling as a form of cybercrime. The increasing prevalence of online gambling in Indonesia poses serious legal challenges due to its transnational nature, the use of digital platforms, and the complexity of electronic transactions. This study aims to analyze the legal framework governing online gambling offenses in Indonesia and examine the strategies implemented to address such crimes. This research employed a normative legal research method using statutory, conceptual, and case approaches. The study relied on primary legal materials, including legislation and court decisions, as well as secondary legal materials derived from books, scientific journals, and relevant legal literature. The collected legal materials were analyzed descriptively using qualitative legal analysis. The findings indicate that Indonesia has established a sufficient legal basis for combating online gambling through the Criminal Code and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 on Electronic Information and Transactions. However, the rapid advancement of digital technology has created new challenges in law enforcement, including the use of foreign servers, anonymous identities, digital payment systems, and cryptocurrency transactions. These developments have reduced the effectiveness of existing legal mechanisms. Therefore, addressing online gambling requires an integrated approach combining penal and non-penal policies, strengthened inter-agency coordination, enhanced digital forensic capabilities, international cooperation, and increased public legal and digital literacy. The study concludes that comprehensive legal reform and adaptive law enforcement policies are essential to effectively combat online gambling and ensure legal certainty, justice, and social welfare in Indonesia
