This study examines the responsibility of mining companies for mining trucks that cause road damage. The mining activities of PT. Bumi Kejayan in Benerwojo Village, Kejayan District, Pasuruan Regency, which transport andesite rock material using mining trucks through the Wrati Village road, cause road damage that disrupts community activities. The purpose of this study is to analyze the legal regulations regarding the rights and obligations of mining companies in road usage and the forms of legal responsibility for road damage caused by overloaded transport vehicles. The research method used is normative juridical with a statutory approach and case approach. The results show that the rights and obligations of mining companies are comprehensively regulated in the Mineral and Coal Mining Law, the Road Law, and the Road Traffic and Transportation Law. Mining companies are required to use mining roads, but if unavailable, they may use public roads by complying with regulations including road classification and vehicle load limits. The form of legal responsibility is administrative liability as regulated in Article 151 of the Mining Law in the form of administrative sanctions from the Minister, and Article 57B paragraph (3) of the Road Law in the form of warnings, administrative fines, license suspension, and license revocation. Mining companies are also required to contribute to road preservation funds under Article 29 paragraph (4) of the Road Law.
